Maritime Worker's Injuries

When seamen are injured working on the vessels, the laws applied to them are different from Workers' Compensation laws. The Jones Act requires a seaman to prove the negligence of his employer, his coworkers, or simply a defect in the vessel to win his case.

The employer is responsible to provide a "seaworthy" vessel, which is safe for travel on water. As a seaman you can bring a case against your employer if you can prove the "unseaworthiness" of the vessel caused your injury.

FAQs about Maritime Worker's Injury

Maintenance And Cure Fees

If you were injured on a vessel, you're entitled to maintenance and cure fees after your injury.

"Maintenance" is a daily amount equivalent to the food and shelter that would have been provided to you while on the vessel.

"Cure" refers to the obligation of the your employer to provide medical treatment, prescription drugs, nursing services, hospitalization, rehabilitation and therapy. Furthermore, you have the right to choose your physicians.

If your employer refuses to pay you maintenance and cure, you can sue for compensation as well as attorneys' fees.
